If the Agent was unregulated legally YOU THE LANDLORD will have to re-imburse the deposit to the Tenant if the Tenancy Agreement reflects a deposit was taken. On April 7th 2007 The Government introuduced new regulations regarding how Tenancy Deposits MUST now be held - Failure to follow the correct procedures has serious consequences including legal and financial penalties to YOU THE LANDLORD.
